Are Technica has several articles on the subject with the latest one, Pirate Party hosting Pirate Bay in pro-P2P political gesture being the latest one.  The copyright battle is ongoing and this is going to be a much bigger fight than the RIAA or the MPAA could have imagined.  This is not a US vs. the World battle, this is a copyright and usage argument.  It comes down to letting others use material for creative purposes or not.  The big companies will try to prevent the usage of media and materials for creative endeavors.

File sharers will still trade things online.  The difference will be whether there will be fair use for creative purposes or not.  I am siding with fair use.

They also make the point that your ISP, and therefore the MPAA & RIAA won’t be able to come after you since they don’t know who you are. Interesting concept, I wonder how long it will take before they start serving lawsuits to these companies?

Yeah, I just said that.

I have to be honest, I buy from iTunes and I have purchased music from both sites. I understand that the RIAA is having a hard time dealing with the transition to New Media Distribution. That is fine, but they have to realize that ‘their’ customers don’t want music to exist the same way it has in the past 100 years or so. The internet is here and the sneaker-net has always been around. They need to embrace and lead the movement into the digital frontier.

Forget DRM it is dead.

The sooner they understand that the better off we all will be. The ‘people’ or the ‘masses’ will always find a way to beat the systems they put in place. There will always be someone working on a way to crack, hack, rip, burn, and get that content into a DRM-free medium.

Personally, I think Apple’s FairPlay is pretty reasonable. I can burn the music & then if I want it in MP3 format I will have to rip it & that can be a lot of work. Especially since I have 2 Macs and an iPod; with more Macs & iPhones on the list for the next few years.

MP3 is the way music should be delivered and in the highest quality possible. It will never be as good as live; but recorded music has never been that good.

I expect that in 10 to 15 years it will be history and the world & the recoding industry will have moved on. For now the war wages on.

As some of you may have noticed I pay attention to the piracy industry and what happens to those individuals and companies (on both sides of the conflict). I really feel that these ‘rock stars of rebellion’ are breaking the old ideas of how media is distributed and consumed. I also believe that if the Movie and Music industry don’t move FASTER and implement BETTER DELIVERY and BETTER PRICES they will be a relic of the past and the Indie content producers and NetCasters will replace them with better delivery, consumption, and prices.

The problem is they are spending to much time and money licking their wounds and trying to prevent what is happening; instead of changing their methods. They need a new media distribution model to distribute their content. Maybe something like a combination of BitTorrent & iTunes [or Window Media Player] so that every one using it can get a copy of the media faster. No, leave out the DRM and bring the prices into an acceptable range. Yeah that is what I said an acceptable range.

Seriously, they need to flatten their corporate structures so that they don’t have to charge to much for content. 3 to 5 $ for a ‘cd’ and 4 or 5 $ for a movie is acceptable. They also need to get off this staggered release. I will admit that I would pay up to 20$ for a ‘premier’ digital copy of a movie; that means that I can download it during the day and start watching it around 6PM. This also means I own the movie, yeah it is mine. But hey, lets say I have a release party with 10 people and I pay for the movie, we watch it and then 4 of them go home and buy it too. Maybe 6 months to a year later the movie gets dropped to half price and a year later half again.

I don’t know! All I know is that it will change. iTunes is making headway; but it is not enough. Even though it lets me rip my CDs without DRM [w00t! w00t!]. Handbrake lets me digitize my favorite DVDs and store them on an external hard drive for viewing. You just gotta love digital content!!!

I digress, I came across this article on Portfolio.com written by Daniel Roth, ‘The Pirates Can’t Be Stopped‘. This is what started this article off. It is a good read and it covers the attack made by a young man on Media Defender.

The problem of course has two different sides, that of the file sharers and that of the MPAA and RIAA. A point that Peter Sunde makes in the interview is rather compelling. Most of the money is already made before the movie or music is downloadable and many people still go to the theater and still buy music.

This is a very hot topic in the digital media area right now and I will be keeping my eyes on it.
